Welcome to the Native Catalyst™ website (the “Site”), which is owned and operated by Native Finance Development Corporation, a California-based 501(c)(3) nonprofit organization. Native Catalyst’s™ mission is to secure indigenous economic independence by building the institutional frameworks, legal pathways, and financial systems required for tribal self-determination. The Site is designed to serve as a resource for educators, parents, community members, funders, and institutional partners interested in our programs and services.

 

The following terms and conditions, together with our Privacy Policy and such other documents referenced or incorporated herein, constitute the Terms of Use that govern your use of the Site, as well as your use of any and all other online and mobile applications and services owned or operated by Native Finance Development Corporation, whether existing now or in the future. By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time. The effective date at the top of this document reflects the date of the most recent update. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms.

WHO MAY USE THIS SITE

In order to use this Site and/or receive our services, you must be at least 13 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this Site if doing so is prohibited in your country or under any law or regulation applicable to you.

Enrollment inquiries on behalf of a student must be completed by a parent, guardian, or authorized school official. We encourage families to discuss household guidelines regarding the online sharing of personal information before submitting any inquiry on behalf of a minor.

INFORMATION YOU SUBMIT THROUGH THIS SITE

When you submit a contact form, enrollment inquiry, or other communication through this Site, the information you provide including your name, organization, email address, phone number, and any other details you choose to share, may be stored and used by Native Finance Development Corporation to respond to your inquiry, communicate with you about our programs, and maintain our organizational records. Contact information you provide may be stored in a third-party customer relationship management (CRM) system used by Native Finance Development Corporation for internal relationship management purposes. OUR SERVICES AND PROGRAMS

Native Finance Development Corporation and Native Catalyst™ offer educational programs, limited consultation services, and related resources to individuals, tribal nations, educational institutions, and community organizations. Some services are offered at no cost; others are offered at fees determined on a case-by-case basis through direct consultation. Service fees are not listed on this Site. To discuss pricing, scope, and availability, please contact us directly at info@native-finance.org.

 

By submitting a service inquiry or program enrollment request through this Site, you are expressing interest in our services or programs and do not enter into a binding service agreement. All engagements are formalized through separate written agreements between you and Native Finance Development Corporation. Native Finance Development Corporation reserves the right to decline any service request at its sole discretion.

RIGHT TO MODIFY OR DISCONTINUE SERVICES

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services or programs without notice and liability for any reason, or for no reason.

INTELLECTUAL PROPERTY, COPYRIGHTS, AND TRADEMARKS

All original content on this Site, including text, graphics, program materials, and educational resources, is the property of Native Finance Development Corporation unless otherwise noted. Some photographs and images used on this Site are licensed from third-party sources and remain the property of their respective owners.

Certain educational resources in the Relevant Guidance section of this Site are made available under a Creative Commons Attribution-Noncommercial 4.0 International License (CC BY-NC 4.0). Resources designated with this license may be shared and adapted for noncommercial purposes with attribution to Native Catalyst™. Such resources will be clearly marked on the Site. All other content on this Site is protected under full copyright.

RIGHT TO SUSPEND OR RESTRICT ACCESS

We may permanently or temporarily terminate or suspend your access to the Site without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulation. You may discontinue use of this Site at any time.

INDEMNIFICATION

You agree to indemnify and hold Native Finance Development Corporation and Native Catalyst™ harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees) made against them by any third party due to, or arising out of, or in connection with your use of the Site or any of the services offered on the Site.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Native Finance Development Corporation or Native Catalyst™ be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Site or any of its services.

 

To the maximum extent permitted by applicable law, Native Finance Development Corporation assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage of any nature whatsoever resulting from your access to or use of the Site; or (iii) any unauthorized access to or use of our secure servers and/or any personal information stored therein.

From time to time, Native Finance Development Corporation may send you information about our programs, services, and organizational updates by email or other contact methods you have provided. Native Finance Development Corporation is a recipient of federal financial assistance from the Administration for Native Americans. Our programs and services are provided in compliance with applicable federal civil rights laws, including Title VI of the Civil Rights Act of 1964 and Section 504 of the Rehabilitation Act of 1973. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in San Diego, California. The application of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly excluded.
